The following Terms and Conditions ("Terms") apply to all visitors or users ("you", “you're”, or "yours") of our Website and of our web pages (collectively, our “services”). By using our Website, you agree that you have read, understood, and agree to be bound by these Terms of Use (the "Agreement"), whether or not you are a registered user of our Website.

To register and use the services of Trisvaraa, the user must be 18 years of age or above. By registering you hereby warrant that you are 18 years of age or above, and you have the right, authority and capacity to use the services. If the user is underage, it will be assumed that he/she is using/visiting the Platform under the supervision of his/her parent or legal guardian who has read and agreed to abide by this agreement and the Terms set out herein, and shall act on behalf of the minor user while utilisation of the services, including undertaking any financial responsibility for any items purchased through the Website. Trisvaraa reserves the right to deactivate the account without any prior notice if it becomes aware of the absence of such supervision.

Any use or access to the Website by anyone under 13 is strictly prohibited and in violation of this Agreement. If you are under 13, please do not attempt to register for the Website or send any information about yourself to us, including your name, address, telephone number, or email address. If we learn that we have collected personal information from anyone under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about anyone under 13, please contact us at feedback@trisvaraa.com. The Website is not available to any users previously removed from the Website by Trisvaraa. Trisvaraa reserves all rights not expressly granted under this Agreement. Any attempt by you to transfer any of the rights, duties or obligations hereunder, except as expressly provided for in this Agreement, is void.

We reserve the right to amend the Terms at any time without any prior notice to you. Changes and clarifications will take effect immediately upon their posting on the Website and will be applicable to all users. You are required to keep yourself up-dated at all times and review the terms of this agreement from time to time. If you do not agree to any of these changes, you must discontinue using the Website.

By accessing this Site, you are agreeing to be bound by these Terms, all its applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing this Site. The materials contained in this Website are protected by applicable intellectual property rights law.

Trisvaraa is the sole intended beneficiary of this Agreement between Trisvaraa and you. If there is any inconsistency between this Agreement and any other agreement included with or relating to the Goods or Services, this Agreement shall take precedence. This Agreement may not be modified, altered or amended without the written agreement of Trisvaraa. These Terms are governed by and construed in accordance with the laws of India. Trisvaraa and all users accessing this Website agree to submit to the exclusive jurisdiction of the courts at Gurugram, India.

• The Website and all of its content, including but not limited to, its software or HTML code, scripts, text, artwork, photographs, images, video, and audio are the intellectual property of Trisvaraa.
• All content is provided by Trisvaraa as a service to its current and prospective customers and may be used for personal use and for purchasing purposes.
• You are authorised to print a copy of any information contained on this Website for personal use unless such printing is expressly prohibited. Without limiting the foregoing, you may not, without our written permission, sell information obtained from this Website.
• You may not copy, alter, reproduce, publish, transmit, distribute, perform, display, post, modify, create derivative works from, sell, license, or otherwise exploit this Site or any of its content without our prior written permission.
• You may not use this Website, or any of its content, for any commercial purposes, including any advertising or advertising revenue generation activity on your own Website.
• Any unauthorised copying, alteration, distribution, transmission, performance, display, or other use of these materials is prohibited.
• All third party designs featured on Trisvaraa are copyright and intellectual property of their respective designers and cannot be reproduced or transmitted in any form without the prior written permission of the designers.
• You may choose to or we may invite you to submit comments or ideas about the Website, ncluding without limitation about how to improve the Website or our products ("Ideas"). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Trisvaraa under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, Trisvaraa does not waive any rights to use similar or related ideas previously known to Trisvaraa, or developed by its employees, or obtained from sources other than you.

• Reproduction or misuse of any trademarks and logos on the Website is strictly prohibited.
• Trisvaraa retains all rights regarding the Trademarks, trade names and brand name. These marks, names and all associated logos or images, are registered and/or common-law trademarks protected by local and international laws and treaties. No license to the use of such marks or names is granted to you under these Terms.

You agree that:

• You will not misuse our Services (e.g., you will not use our Website in any way which is unlawful, illegal, fraudulent or harmful).
• You will not engage in any copying, distributing, or disclosing any part of the Website in any medium, including without limitation by any automated or non-automated "scraping".
• You will not use any automated systems, including without limitation "robots," "spiders," "offline readers," etc., to access the Website in a manner that sends more request messages to the Trisvaraa servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (except that, subject to the privacy settings of our users, Trisvaraa grants the operators of public search engines limited revocable permission to use spiders to copy materials from the Website for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials).
• You will not transmit spam, chain letters, or other unsolicited email.
• You will not attempt to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Website.
• You will not upload invalid data, viruses, worms, or other software agents through the Website.
• You will not make any speculative or fraudulent orders. You may only use the Website to make legitimate orders and inquiries.
• You will not conduct systematic or automated data collection activities (including without limitation scraping, data mining, and data harvesting).
• You will not alter another website so as to falsely imply that it is affiliated or associated with Trisvaraa.
• You will not conduct derivative usage of this platform and carry out resale of its products.
• You are responsible for all use of your account (under any user name or password) and for ensuring that all use of your account complies fully with the provisions of these Terms.
• You agree to assume all risk, liability and consequences if your account is accessed illegally or without authorisation through means of hacking. Any liabilities arising on account of purchase pursuant to such unauthorised use shall be borne by you.

Trisvaraa may terminate the Services or any portion thereof, or any products or services offered through the Website.

We may permanently or temporarily terminate or suspend your access to the Website without notice or liability to Trisvaraa, with or without cause, including if in our sole determination you violate any provision of this Agreement. Upon termination of this Agreement or your access to the Website with or without cause, you will continue to be bound by the terms of this Agreement which, by their nature, should survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

By placing an order for any goods on our website you are subject to the following terms and conditions.

• All orders are subject to availability and confirmation of the order price.
• Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are estimates only. At Trisvaraa, we will not be responsible for any delays resulting from postal delays or on account of a force majeure event.
• When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
• The cost of the products may fluctuate with seasons. All prices advertised are subject to such changes.

A contract between Trisvaraa and you for the purchase of the goods will not be effective until your payment has been approved and our billing agent has debited your credit or debit card. Accordingly, we are not liable for delivery of any orders placed by you till such time the payment has been collected by our delivery agent.

• Please note that items in your shopping cart are not reserved and may be purchased by other customers. After you place your order, you will be sent an email to confirm that your credit/debit card has been charged.
• Your card account is debited at the same time you submit your order on our Website. If your order has not been approved, you will be notified immediately via our Website. In the rare instance that your order is approved but any of the items you have ordered are not available, we will contact you immediately by email to arrange for a full refund or a product exchange, if preferred.
• Unless you cancel your order, acceptance of your order and completion of the contract between you and Trisvaraa will be completed when we e-mail you to confirm that your payment is approved and the order is in process.
• The Website and communication are always conducted in English; therefore, the final sale contract will also be in English.

We reserve the right to not accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards. Trisvaraa shall not be liable for any rejection of orders for any reason whatsoever.

You agree to pay the Purchase Price of the Goods as posted on this website attached hereto. Due to the nature of the products supplied by us, we do not accept any cash on deliveries.

While Trisvaraa makes every effort to ensure that the products are described and priced accurately, in the event that an item is deemed to be priced incorrectly, Trisvaraa reserves the right to refuse the sale of that item.

Any change in taxation under applicable laws shall be effected immediately. During instances where an order has been placed and there is a change under taxation laws before the shipment is executed, any excess amount charged as tax will be refunded as store credit while any due tax amount will be collected during delivery. Non-payment of the due tax amount shall result in refusal of delivery.

Please note customers ordering outside of India will be charged estimated custom fees. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

For customers ordering outside of India, the issuer of your credit or debit card may charge currency conversion or other fees in relation to your order. You should check with the issuer of your credit or debit card for details of any such fees.

The colours of products you see on the computer screen will vary slightly from those of the actual product delivered. The appearance may vary due to number of factors like underlying technologies of computer, different monitor calibration, lighting used while taking photographs, etc.

The sizing of each product may vary from generic sizes commonly known, depending upon the fabric and stitch, therefore you are required to check the sizing of the product before placing an order.

Though Trisvaraa takes reasonable efforts to provide accurate visual representation, it disclaims any guarantee of the exact likeness of the visual representation or description of the product with the actual product delivered.

The total amount of the Purchase Price shall be payable in full by you according to the payment due date stated at Checkout.

The rights hereby mentioned are limited, revocable rights.

Trisvaraa endeavours to ensure that every transaction at our website is seamless. We take great care in delivering our products and adhere to the highest quality standards.

As a policy, we do not offer returns or exchanges on products which are delivered in perfect condition as per the order placed. However, if the product is wrongfully delivered (i.e. the product does not match the item in the order confirmation) or has a genuine quality / manufacturing defect, then we are open to re-fulfilling your order.

If you think that there is a fault with the goods you have received, please let us know straight away, and no later than 48 (forty-eight) hours from the delivery of the goods by contacting us at customercare@trisvaraa.com. Please include all the details about the order and the problem with the goods, including photographic evidence of the faulty goods. We will only accept re-fulfilment of orders that are not of acceptable quality. Trisvaraa’s decision on whether the goods are of acceptable quality or not shall be final and conclusive in this regard.

Given the exclusive nature of our products, we reserve the sole discretion to provide the resolution to any situation as we deem fit. Each return or exchange request is handled on a case by case basis and we request you to get in touch with our team for prompt resolution, and in no case later than 48 (forty-eight) hours from the delivery of the goods.

Dupattas, stoles or scarves, finished sarees and customized stitched ensembles are NOT eligible for exchange. Any products made on order and customized for size or other requirements are NOT eligible for exchange.

This section applies to the return of all goods, regardless of whether they are faulty or you need a different size.

You must request a re-fulfilment of order or exchange on account of faulty goods within 48 hours of receipt of the goods.

The item/s must be in original condition, with the original packaging and with all tags still attached.

Item/s must not have been worn, washed or altered in any way.

Please take care when trying on garments, as we cannot accept garments that have make up stains or garments that smell of perfume.

Returns that do not meet our policy will not be accepted. We only accept re-fulfilment of orders or exchanges as per the policy set out herein. In order to maintain fairness to our artisans and craftsmen, as well as keep our prices fair, many items are "Final Sale." Please make it a point to understand which products are eligible for returns before purchasing.

The item/s must be returned to us before the exchange/re-fulfilment is made.

Once the items have been received, you will either receive your new item (for exchanges), or a full refund for faulty goods.

DECISION OF TRISVARAA REGARDING ANY RE-FULFILMENT / EXCHANGE / REFUNDSHALL BE FINAL AND CONCLUSIVE.

Trisvaraa will be taking the responsibility for the costs of returning the goods. Once you communicate your desire for a re-fulfilment/exchange we will be emailing you the return notes and labels. Our delivery representatives from your area will come to pick up the goods along with the papers we will send via email once a return request is made, we insist you keep the items properly packed for the pickup. In the rare instance that we are unable to send a representative to your assigned address, you may have to drop the package to a local post office.

No refunds would be given if the customer has provided wrong or incomplete shipping address, there are 3 (three) failed delivery attempts by our courier partners and / or the package is refused by the recipient.

At Trisvaraa, we will do our best to ensure your order is fulfilled. However, we reserve the right to cancel the order if we do not have sufficient stock.

In the event of cancellation, we will contact you by e-mail within 48 hours of receiving your order. If we cannot fulfil the order, we will re-credit your account immediately. Trisvaraa will re-credit your account for the value of the goods and shipment only. Trisvaraa does not reimburse any bank charges you may have incurred in the transaction.

Please note card refunds may take up to 10 business days for your bank to complete, depending on their processing time. This can vary greatly between card issuers, and unfortunately, we are unable to influence this.

Cancellation requests will be accepted strictly within 24 hours of placing the order only.

Trisvaraa aims to ship any orders within 7 days. Goods purchased on order will take upwards of 3 weeks (excluding weekends and public holidays). We will contact you via email, to let you know the time required to complete your order. If you contact us and the order has already shipped, we cannot cancel the order.

Please also note cancellation will not be possible if the order has been customised to your size and requirements.

Please note that no requests for refunds / returns / exchange shall be entertained for the following products under any circumstances whatsoever:

• Sarees which have been customised and finished with falls, tassels etc.
• Pre-ordered stitched ensembles.

Unless otherwise agreed in writing, delivery dates provided by us are estimates only. We will make reasonable efforts to deliver in accordance with such dates; however, Trisvaraa will not be liable for failure to deliver as estimated. Unless otherwise agreed in writing by us, goods shall be packaged according to our standards and practices.

At Trisvaraa, we take great care in delivering your products to you, and we partner only with reputed national couriers. Shipping within India is FREE for all orders above INR 50,000. For international shipments, Trisvaraa shall be charging shipment costs as per the terms of its international courier partners. Any customs duties and other taxes shall have to be borne by the recipient (please see the provisions of (a) below).

Because each craftsman and artisan's process is unique, shipping times may vary. Look for shipping info on the product page for individual shipping times.

Our courier partners will be able to deliver the shipment to you between Monday through Saturday: 9am to 7pm. Working days exclude public holidays and Sundays. Delivery time is subject to factors beyond our control including unexpected travel delays from our courier partners and transporters due to weather conditions and strikes.

Address change will be accepted only if order has not been shipped.

As soon as your package ships, we will email you your package tracking information.

You are responsible for assuring that the product can be lawfully imported to the destination. Orders that are shipped to countries outside of India may be subject to import taxes, customs duties and fees levied by the destination country.

The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the destination country. Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and cannot predict what they may be. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates, and we will not be responsible for any such delays.

In case of international orders, if a customer refuses to pay the duty as mandated by the respective country of shipment and doesn’t collect his / her order from the international courier partner, then Trisvaraa will not be liable to refund any amount for such orders.

Trisvaraa provides free insurance on all products being delivered to customers in India. However, for users outside India, a nominal insurance premium may be charged by Trisvaraa in addition to the product charges. The insurance is valid only till the time the product reaches the customer will lapse as soon as the customer will sign the receiving.

Trisvaraa shall not be held responsible for any failure of performance to make timely delivery due to:

• Any governmental action, statute, ordinance or regulation, strike or other labour trouble, including any terrorist attacks, acts of war or internal mutiny;
• Fire or other damage to or destruction of, in whole or in part, the Goods or the manufacturing facility for the Goods;
• The lack of or inability to obtain raw materials, labour, fuel, electrical power, water or supplies, or any other cause, contingency or circumstances not subject to the reasonable control of Trisvaraa, which causes delays or hinders the manufacture or delivery of Goods;
• We shall determine in good faith and in our sole discretion the extent to which we can reasonably control a cause, contingency, or circumstance that affects the performance of our obligations.

You have the right to expect that:

• Any products you order through the Website will be of satisfactory quality, fit for their intended purpose, and will conform to the description given on this Site
• Certain remedies will be followed if a product is agreed to be defective
• You have the choice of a full refund or a credit if a defective product cannot be repaired or replaced

THE SERVICE AND ANY PRODUCT OR SERVICE YOU PURCHASE THROUGH THE WEBSITE (“PRODUCT”) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE WEBSITE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCTS ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, TRISVARAA, ITS PROMOTERS, ITS SUBSIDIARIES AND ITS RELATED PARTIES DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE OR CORRECT; THAT THE PRODUCTS WILL MEET YOUR REQUIREMENTS; THAT THE PRODUCTS WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE ACCESS TO THE WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. We may make available software to access the Service via a mobile device ("Mobile Software"). To use the Mobile Software you must have a mobile device that is compatible with the Mobile Service. Trisvaraa does not warrant that the Mobile Software will be compatible with your mobile device. Trisvaraa hereby grants you a non-exclusive, non-transferable, revocable license to use a compiled code copy of the Mobile Software for one Trisvaraa account on one mobile device owned or leased solely by you, for your personal, non-commercial use. You may not: (i) modify, disassemble, decompile or reverse engineer the Mobile Software, except to the extent that such restriction is expressly prohibited by law; (ii) rent, lease, loan, resell, sublicense, distribute or otherwise transfer the Mobile Software to any third party or use the Mobile Software to provide time sharing or similar services for any third party; (iii) make any copies of the Mobile Software; (iv) remove, circumvent, disable, damage or otherwise interfere with security-related features of the Mobile Software, features that prevent or restrict use or copying of any content accessible through the Mobile Software, or features that enforce limitations on use of the Mobile Software; or (v) delete the copyright and/or other proprietary rights notices on the Mobile Software. You acknowledge that Trisvaraa may from time to time issue upgraded versions of the Mobile Software and may automatically electronically upgrade the version of the Mobile Software that you are using on your mobile device. You consent to such automatic upgrading on your mobile device and agree that the terms and conditions of this Agreement will apply to all such upgrades. The foregoing license grant is not a sale of the Mobile Software or any copy thereof, and Trisvaraa or its third party partners or suppliers retain all right, title, and interest in the Mobile Software (and any copy thereof). The Mobile Software may be subject to the import and export laws of other countries. You agree to comply with all Indian and foreign laws related to use of the Mobile Software.

This Agreement, together with any amendments and any additional agreements you may enter into with Trisvaraa in connection with the Service, shall constitute the entire agreement between you and Trisvaraa concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Trisvaraa's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
